WOW. Thank You Call 12 for Action!

Your call, yesterday, prompted Mike Burns of Camelback Consign & Design to FINALLY make good on his rubber check of September 13, 2013 for $2194.40

Mr. Burns still owes me in excess of $7,859 based solely on the sales reports he gave me. The estimated sales value of items not returned and not listed on the sales reports received exceeds $19,530. Both estimates and the corresponding spreadsheet were recently provided to the IRS.

BUT THIS WAS A WELCOME START! I am grateful to Channel 12 and all others who have played a (less visible) role in the process.  

Keep up the good work, I say! I plan to keep up the pressure from my end, too.

1st Follow-up to Original Complaint Submission  (11/13/13)

Apologies. I’ve not heard back on my submission of 11/5/13 regarding Camelback Consign and Design 602.279.5233. Thus this follow-up.
 Synopsis:
Camelback Consign and Design (CCD) received hundreds of antiques, pieces of fine furniture, crystal, porcelain, etc. from me (i.e., my parents’ estate)  in July. It reported selling over $15,000. Based on our contract, which expired on 10.9.13, it owes me > $10,000 (65%). I received one check – in September – for $2194 covering July sales. It bounced. I have received no other money. CCD allowed me to pick up some unsold items, but has refused to make others available. The owner, Michael Burns, is a very personable man; he has promised payment and the return of my items for over a month…again and again and again.
 I might add that Mr. Burns received very detailed inventories along with all items; and that I have photos of every single item delivered to him, etc.
 Because I really believed him and expected good things from our relationship, the resulting emotional and financial costs have been punishing, to say the least. 
If you can help, I would truly be appreciative. 
A more detailed “Basic Complaint” is attached as a word doc. Add’l documentation is attached, such as the sales inventories, bounced check, original contract, etc.
Update on 11/20/13…
I met yesterday with Mr. Burns to receive the promised NSF check reimbursement. He was gracious but only had a money order for $1000 as opposed to one or more certified checks totaling the $2194.40 owed on that check. On the advice of my attorney I did not accept partial payment. Mr. Burns promised to have the full sum and clarified sales reports or some non-returned items today.
Mr. Burns acknowledged that certain items he previously said weren’t sold had, in error, been sold at prices far below the absolute minimums I had assigned. He said that he expected to get the most valuable of those items back from the person who bought it.  
Today, by email, I offered to sign up with Swipe.com so he can pay me using his credit card.
I’ve not heard from him.
Somehow, I can’t help but like Mr. Mike Burns… despite everything and despite my real upset. Maybe that’s part of the problem; maybe it helps achieve a solution. Dunno.

Thereafter, I was referred to Maury, whom I sent a lot of background information, including a copy of my contract.

Glenn,
I spoke with Mr. Burns who says he is working with you and your attorney to resolve the situation by paying you the full amount and returning the goods he possibly can………….he thinks you had/have an agreement but did admit it’s not in writing. He also claims you are harassing him and continue to change the verbal agreement.
You and your attorney may want to consider putting the agreement in writing to defray any future ‘he said, she said’ type issues.
I don’t know if there is anymore I can do but will follow up with you after we return from Turkey Day.

Maury, thank you.

Mike Burns  and I agree on a number of things. We agree that he owes me money. Agree that he should make good on his contract. Agree that he told me things that proved not be true about whether certain items were sold or not sold. Agree that he should “make things right,” his words.

I told Mike that I don’t want to sue him and am willing to accept a piecemeal approach to resolution. I will work with him.

I also told Mike Burns that my willingness to restrain myself requires that he fulfill his promises. Starting immediately. Tuesday, not for the first time, I told him to make small promises and keep them, as opposed to making large commitments. Actually doing a small thing would be a good start and proof of good will.

Right now, I hold an NSF check dated 9/13/13. It’s over two months old. Mike called me last Saturday late afternoon and said he had the money (for the umpteenth time). He left that message on my voice mail. Twice. I went by Sunday morning and the money wasn’t available. He’d have it Monday. Monday came and went. Tuesday we met at 4 pm. I expected to see money. He had a partial payment and I’ve been advised not to accept a partial payment, only the complete amount. He promised to have that money and more, on Wednesday.

Wednesday, after 6 pm, he called and told me he’d had a great day but was alone at the store and couldn’t leave to get a cashier’s check. I’ll call you tomorrow at 11 am he promised.

I don’t have time to pester Mike. I don’t enjoy it. I know he doesn’t like it. The solution is simple. Make an agreement. Honor it.

I am not the problem, here.  I have the problem.

Just a follow-up. On Monday Oct 21, 2103, Mr. Burns told the BBB he would settle my account in the week.  He didn’t. The BBB now gives the firm a No Rating… and makes all existing complaints inaccessible. Yelp apparently only allows one negative review per business. The Attorney General’s office doesn’t seem to be moving very quickly, either. In short, various public or private institutions the public expects will provide guidance or protection, aren’t.   

I’m not the only one! I need help, yes. But what about the other folks out there, already mistreated or waiting in line for their turn to be taken?

I tried Mike today and he was ‘busy.’ There is not much more I can do if he won’t respond and you may have to have your attorney ‘go legal.’ I would guess you could file a lien on the business and that may get him to act.

Maury, turns out that Mike Burns doesn’t own a piece of real property that can be attached.  See the attached report by a private investigator. This is one coolly conceived scam.

I’m guessing that most folks with such complaints find the process of going to court too difficult, costly and or time consuming. Then again, going to court and winning doesn’t mean much if there is nothing to be won. The thing is: no news adds up to real money for the ill-behaved. The result: more and more folks get scammed.

I’ve already demonstrated that key social media entities – such as the BBB and Yelp - intentionally or unintentionally shelter scammers by failing to provide a venue for critical comments – in a timely manner. That amounts to anti-social behavior.

Does Channel 12 only acknowledge / report on positive outcomes? That would be a shame. If no one exposes the institutional issues that enable “businessmen” like Mike Burns to graze on the unsuspecting, those issues won’t be addressed. More people will be hurt.

It’s never too late to expose institutional inertia.

At 1:30 PM, shortly after I received Maury’s email (below), Mike Burns called to tell me that he wanted to make his bounced check from 9/28/13 good. At 2 PM, he gave me a $1000 money order and $1200 in cash and signed a receipt prepared by my attorney. It says receipt of payment will not compromise other outstanding claims. I deposited the funds promptly.

Thank you. Assuming the money order is good, it will be the first and only payment received from Mr. Burns toward the over $15,000 in gross July – Sept. sales that he reported to me. He hasn’t reported sales for October. In the excitement, I forgot to ask for that sales report.

Mr. Burns said that he will return many of the items he previously reported sold. He said that he would get the items from the folks he sold them to and reimburse them, then return the items to me. He has said as much before. I hope he does. He said I would hear from him soon.

Mr. Burns also said that he had me investigated. “You must have hidden your past well,” he said. “l could only find four pages of calls to the police.” He offered no details.  I said I had nothing to hide, that I’m an honest guy. “That’s not what your neighbors said, “ responded Mr. Burns.

Mr. Burns indicated that this was just the beginning and drove off.  

Whatever you did or said helped.  I am terribly appreciative, the money will come in very handy. I hope you will stay in touch with him and with me so that Mr. Burns either pays me in full or returns the items he received (in good condition, I pray).

I imagine you’re overwhelmed with requests for help and haven’t had a chance to respond to let me know if you ever got through to Mike Burns.
Apparently, there is so little protection for the proverbial “little” guy, that amazingly kind folks like yourself are pushed to the limit.
FYI: Attached find eight (other) complaints by folks I don’t know about their respective experiences at Camelback Consign and Design, this year. All were dredged up on the Internet. On my computer, they’re best read at 125%.
There’s a reason to put the fear of media exposure into Mr. Burns, if only to prevent more people from being “burned.”

Working with me? I’ve heard nothing more. He still owes over $7000, 80 items (worth as much)  and an October sales report. If receive anything more, you’ll the first to know.

If I don’t, would you call him again, say around Jan 13,  to remind him of his outstanding obligations?

I want it all. I hope  you can get him to deliver it piecemeal, at a reasonable rate.

Mr. Burns knows I accrued $70,000 in legal fees fighting for some of the items he received. That money was meant to pay my legal bills, not his.

Happy New Year, Maury!

I’ve received nothing more from Mike Burns since he made his $2194.00 NSF check good on  12/13.  He hasn’t even provided my long overdue October sales report. He still owes me, by his own accounting, $7859.46. This doesn’t include the value of the 80 items unaccounted for.

Mike called me once after Xmas. I had mailed a nicely worded request to his wife  to intercede on behalf of all those whom Mike had failed to pay or return items to for help. I sent her copies of the complaints gleaned from the internet. Mike heard about it and asked me not to contact his ex-wife  any more. I agreed.

He indicated that he was working on my issues, but wouldn’t commit to anything. “You’ll only use it against me,” he said.  

I would appreciate it if you would urge him – yet again – to fulfill his obligations using the leverage at your disposal.

Thanks!  I’ll let you know if I hear anything positive on my end. Please update me if you’re able to speak to Mike just so I know what has happened.

Personally, I don’t think a single story by Channel 5 – last July – constitutes “plenty” of media exposure, but perhaps I’m jaundiced.

I picketed the store Saturday and Sunday. (Attached find a photo of me on the picket line Sunday afternoon.)

Sunday, for some reason, Camelback Consign and Design was closed. Anyway, during the later afternoon on Sunday, I was approached by an elderly gentleman who asked,  “Does he owe you money, too?” A lady drove up who asked what I was doing and why. She, in turn, told me that she had left some items on Saturday, to be appraised. Hopefully, not too many more folks will be hurt.  

I plan to keep picketing on weekends for some time.

Mike Burns wasn't born yesterday. He wasn't born on the Fourth of July, either. NOPE. Mike Burns was born on 9/11 in 1952. 
He was destined. 
Don't forget to tip a hat to Ms. Indispensable, Vera Manuz, either. Where would Mike be without her?


I don't know if the truth will set you free. But fuss loud enough with a big 'nough bunch a friends and I swear folks 'll do near anything to get you to shut up. Fast as they can.

  1. you all can find mike burns late evenings.At casino Arizona at Mckellips gambling all of your hard earned money away.they could even real the cameras back for all to see.He could care less for stealing and fraud,he needs to go to jail.have him paged at the casino maybe the arrogant person he is.he'll come to the phone.
