This morning, January 25, 2014, Mike Burns reached me by cell phone with the hoped for offer of a resolution to my outstanding claims against Camelback Consign and Design just as I was driving there to picket yet again. For more details, see the blog posts listed at the bottom of this page.
The following is my summary of the proposal and response, in the form of an email to Michael Burns, owner of Camelback Consign and Design.
Subject: My suggested Arbiter & a review of your proposal // glenn michaels
Mike, I do appreciate hearing from you this morning with regard to a resolution of my concerns. I sincerely hope that we can reach an accord quickly and with a minimum of effort.
Please review the following description - in the bold, blue font - of your proposal to make sure that I understood it correctly. Should any of the following seem inaccurate or otherwise open to question, please let me know so that it can be discussed.
You said that you would have a complete list of my missing items and an estimate of their respective fair market values by Monday evening latest.
You proposed that both of us turn over our respective valuations for each of the missing items to a third party dealer or appraiser of my choice, at your expense. That individual would then judge and assign the fair market value of those items, which both of us would agree - in advance - to accept.
The final resolution - as I understand it - would include return all of my consigned items in your possession that have either not sold or been delivered, payment of the outstanding amounts for items that did sell per your sales reports, and payment of the fair market value of items that were not returned.
Payment would be in the form of a cashier's check. (Cash is acceptable.)
I suggest that we ask Bill Bishop of the Bishop Gallery, 7164 Main St, Scottsdale, (480) 949-9062, to serve as arbiter. Should he not be willing or able, I would suggest asking the buyer from the antique store located near you, Relics, to serve as arbiter.
We failed to address the issue of items sold for less than the minimums that were established when I turned them over. I imagine that you will suggest that fair market value should control that valuation.
I would agree, except that the "personal" value of certain of these items could quite easily exceed their fair market value. I think specifically of the matched antique china jars, the antique wooden corbels and the antique French footbath with matching pitcher.
However, at this time, as I don't which items will be returned nor what the actual sales prices were for those items that were sold but are now unaccounted for, I will wait and see.
I am prepared to acknowledge lower than desired valuations for my items. On the other hand, I think it fair that you also accept responsibility for not fulfilling the terms of our contract and the associated costs to me.
We are both agreed that we would like to see the matter resolved as quickly as possible. You indicated that you have the funds to pay me. I indicated that I would much rather be doing things other than making life difficult for you.
Separately....
I agreed to cease picketing this weekend in anticipation of your fulfillment of the first part of this offer by next weekend, latest. I also stated that if you have not fulfilled your commitment to move this matter to arbitration by providing valuation lists by next Friday, latest, I will again begin picketing.
Again, thank you for your efforts to resolve this matter equitably.
