Want to give an accused the "benefit of the doubt" to protect the innocent? OK by me. Want to ignore the plight of good citizens - true innocents in the jungle of AZ law & enforcement policy -  because the victim count hasn't piled high enough to justify these officials'  time and attention?What about the fact that said officials won't report how many complaints they've received about a given accused to begin with? NOT OK. Shame on us for tolerating it.

Attention Office of the Ombudsman

I submitted a complaint (CIC 13-13018, attached) to the office of the AG on 102713, re a business predator, Camelback Consign & Design, LLC., along with a significant amount of supporting documentation.

I received an initial response on 11/12/13. Having head nothing further, I followed up in February, my letter attached. 

The response came on 3/20/14. It was a duplicate of the initial response.

I wrote a very angry follow-up, attached, 3/25/14, it went to the AG, himself, his Chief of Staff, and Ms. Heather Pellegrino, Section Chief / Civil & Criminal Litigation. Admittedly, I could have been a little less provocative. But humility hadn't gotten me much by way of a meaningful response.

The AG's response to that letter came on 4/2/14, also attached. 

In it, Nikki Harvey, the Consumer Information and Complaints Manager, apologizes for having sent me a letter in February that was a duplicate of the first letter I received from the AG's office, in November 2013.  Aside, however, from the apology and the possibly personal signature on the bottom, it, too, was a duplicate of the earlier letters.

Just like the form letters that preceded it, Nikki's version noted that the Consumer Protection and Advocacy Section of our office "has reviewed your complaint is attempting to make contact with the business. The complaint process can sometimes be very lengthy."  

The AG's office has a talent for understatement. 

So, by my count, after five months of concerted effort, the AG's office has yet to make contact with a business located less than six miles from its own front door. Is it any wonder that the complaint process can be lengthy!?  

I'm upset that:
  
The AG's office is misrepresenting its efforts by omission, assuming it has done anything at all. I can reach the predator in person, by phone or email, myself, in minutes. Why can't the AG?

The predator's failure to respond to the AG, if a letter went out, has obviously worked to the predator's advantage. The AG hasn't done a thing about it.

The predator is still hard at work, victimizing folks. I know that because I've been contacted by a few through my outreach efforts http://camelbackconsignanddesign.blogspot.com. At this point, the blog probably contains more information than you really want to review. But there are several posts that pertain to the AG and that document everything I've written here.

I also know it because I'm tracking complaints on the BBB website and Yelp, among other locations.

I'm damned angry that a crook is getting a free ride at good citizens' great expense, due to the apparent disinterest and inaction of the entity I've been told is charged with protecting us.

I've contacted state legislators, also by email, but they're busy with more important matters. My ability to influence the AG's office directly is nil. The media seem largely disinterested.

 I've talked with a staff member for Congresswoman Sinema, who passed on information to the AG's office and promised to get back with me. I then contacted Gerald Richard, assistant to the Chief of Police for Phoenix, who also promised to let me know what he found out.  I spoke with the former about  eight days ago and with the latter four or five days ago. 

Neither has reported anything back to date. Perhaps I'm a tad impatient. But, you know, there are most likely folks at Camelback Consign & Design right now, buying stolen items or delivering items that will shortly be stolen. 

Equally infuriating is the thought that there are likely many more such predators out there  having the time of their lives because they know they can get away with it.

UPDATE - October 3, 2014:

Three of the four letters received from the AG's office use the familiar salutation, "Dear Glen," misspelling my name. But that aside,  I'm fascinated to learn that we are on a first name basis although we've never been introduced. 

The thing is, Tom, If the AG's office can't do something as simple as spelling my first name correctly, what hope can Arizona citizens have that it will do the big things correctly? 

Tell me, Nikki, why did it take more than a month for your office to mail me a notification that  a lawsuit had been filed? The letter I received is dated September 26th. 

Can you tell me, Tom, if my complaint to your office is part of the lawsuit? The letter seems to imply, but doesn't clearly and unequivocally state that my complaint was incorporated in the lawsuit. Had it come from another agency, I would have assumed that the implication could be relied upon. But you folks are attorneys. And I now know that implied promises are simply one many ricks attorneys use to increase their income through arbitration or other legal actions. . 

This letter promises, "When the lawsuit is complete, we will notify you of the outcome."
Wow, thanks. Thing is, I can pretty much guess the outcome.

  • Since this is a civil suit, "the defendant" won't go to jail. 
  • As the defendant is busy gambling away whatever funds he has - or is otherwise disposing of the goods and money he and his employees defrauded his clients of, there will be no reimbursement for losses incurred.
  • Since the defendant is 62, most likely unemployable as a result of his crime spree and reputation,   and will not be allowed to go into business again in Arizona, there will be little or no future income to garnishee.
  • Since the AG didn't charge the defendant's much younger partner (and son) or his longtime sales associate(s), they won't be making any contributions to the victims' either.
On the other hand, the AG's November 12, 2013 letter made the following promise, "We are in the process of contacting the company to request a response. When we receive the response, we will send a copy of it to you."

Nearly a year later, despite the fact that the defendant was subpoenaed by the AG's office, I never received a copy of the response provided by the defendant. UPDATE - August 19, 2014: 

After three major articles in the Arizona Republic about Camelback Consign & Design and it's president, Michael Burns (aka the Camelback Vampire), including an admission that he cheated consignors, after TV segments by Call Joe, 5 on Your Side, and Call 12 for Action, after Burns was apparently subpoenaed by the Attorney Generals office and an investigation initiated in April 2014 and after dozens of complaints by consignors about the theft of their items or non-payment....

Mike Burns remains a free man. Unindicted. No prosecution announced by the AG. 

Yup, that's right. As soon as he can scrape together the wherewithal, he's free to do the same thing all over again.

Point Taken: If the State Treasurer showed the same level of commitment to delivering
 paychecks to the AG's office, the staff would have long since starved to death.
